REPORT OF EXECUTIVE

 

 

1.0       PURPOSE OF THE REPORT

 

1.1       To provide Council with details of reports received, decisions by the Executive and any subsequent recommendations to County Council since the last meeting of the County Council on 20 July 2022.

 

 

2.0       DETAILS OF THE MEETINGS

 

2.1       The following sections provide details of decisions made by the Executive and recommendations to the County Council since its last meeting on 20 July 2022.  The meetings were held on the following dates:  19 July 2022; 23 August 2022 (Performance Monitoring); 6 September 2022; 20 September 2022; 18 October 2022 and 25 October 2022.  A meeting of the Executive is scheduled for 8 November 2022 but this report was published before that meeting took place and so only details of the agenda items are included.

           

2.2       19 July 2022 Executive Meeting

The Executive Members met on Tuesday 19 July 2022.  Attending the meeting were:  County Councillor Carl Les in the Chair plus County Councillors Gareth Dadd, Derek Bastiman, David Chance, Keane Duncan, Michael Harrison, Simon Myers, Janet Sanderson and Greg White.

 

Apologies:  County Councillor Annabel Wilkinson.

 

In attendance: County Councillor Paul Haslam.

2.3       23 August 2022 Executive (Performance Monitoring) Meeting

The Executive Members met on Tuesday 23 August 2022.  Attending the meeting were:  County Councillor Carl Les in the Chair plus County Councillors Gareth Dadd, Derek Bastiman, David Chance, Keane Duncan, Michael Harrison, Simon Myers, Janet Sanderson, Greg White and Annabel Wilkinson.

2.4       6 September 2022 Executive Meeting

The Executive Members met on Tuesday 6 September 2022.  Attending the meeting were:  County Councillor Carl Les in the Chair, plus County Councillors Gareth Dadd, Derek Bastiman, David Chance, Keane Duncan, Greg White and Annabel Wilkinson.

2.5       20 September 2022 Executive Meeting

2.6       18 October Executive Meeting

2.7       25 October 2022 Executive Meeting

3.0       MATTERS FOR APPROVAL/INFORMATION AT COUNTY COUNCIL

 

3.1       The Executive considered the reports and resolved to recommend the following to the meeting of County Council for consideration:

 

3.2       Q1 Budget Report

 

            This item was considered at the meeting of Executive on 23 August 2022, where the Executive recommended to County Council on 16 November 2022 that it approves the revised Prudential Indicators for the period 2022/23 to 2024/25 as set out in Appendix A to the report.

RECOMMENDATION:

 

 

That the revised Prudential Indicators for the period 2022/23 to 2024/25 as set out in Appendix A to the report be approved.

 

 

3.3       North Yorkshire Council Flood Risk Management Strategy

 

            This item was considered at the meeting of Executive on 6 September 2022, where the Executive recommended to County Council on 16 November 2022 that the Local Flood Risk Management Strategy be approved and adopted.

RECOMMENDATION:

 

 

That the Local Flood Risk Management Strategy be approved and adopted.

 

 

3.4       Council Tax Premiums on Second Homes and Empty Properties

 

            This item was considered at the meeting of Executive on 20 September 2022, where the Executive recommended to County Council on 16 November 2022 that additional Council Tax premiums be applied from 1 April 2024 subject to the required legislation being in place.

RECOMMENDATION:

 

 

That, in principle, the following additional Council Tax premiums be applied from 1 April 2024, subject to the required legislation being in place:

 

·        100% premium for properties which have been empty and unfurnished for a period of between 1 and 2 years;

·        100% premium for second homes 

 

be approved.

 

 

3.5       Changes to the County Council’s Constitution for recommendation to full Council

 

            This item was considered at the meeting of Executive on 20 September 2022, where the Executive recommended to County Council on 16 November 2022 that the proposed changes as detailed in the report be approved.

RECOMMENDATION:

 

 

That:

 

i.          The consequential amendments to the Constitution in respect of the new Members’ Code of Conduct as set out in the report and Appendix 2 of the report made by the Assistant Chief Executive (Legal and Democratic Services) and Monitoring Officer under his specific delegated powers be noted. 

 

ii.    The consequential amendments to the Constitution in respect of the local government reorganisation transitional arrangements and Structural Changes Order as set out in this report and Appendix 3 of the report, made by the Assistant Chief Executive (Legal and Democratic Services) under his specific delegated powers, be noted.

 

iii.        The changes to the Constitution set out in Appendix 4 of the report, made by the Assistant Chief Executive (Legal and Democratic Services) under his general delegated powers, be noted.

 

iv.        The proposed amendments to the Pension Fund Committee Delegated Powers and to the Specific Delegations to the Corporate Director Strategic Resources as set out in Appendix 5 of the report, be approved.

 

v.      The proposed amendments to the Constitution set out in paragraph 7.4 of the report to reflect the Channel Panel arrangements, be approved.

 

 

3.6       Appointment to Committees and Outside Bodies

 

            This item has been included in the separate and stand-alone report on Appointments later in the agenda for this Council meeting.

 

3.7       Recommendations regarding Motions on Climate Change

 

            This item has been included in the separate and stand-alone report later on in the agenda for this Council meeting.

 

3.8       Council Tax Reduction Scheme

 

            This item was considered at the meeting of Executive on 18 October 2022, where the Executive recommended to County Council on 16 November 2022 that the Council approves the new, income banded/grid Council Tax Reduction Scheme for working age applicants with effect from 1 April 2023, referred to in Sections 5 and 6 of the report.

RECOMMENDATION:

 

 

That the new, income banded/grid Council Tax Reduction Scheme for working age applicants with effect from 1 April 2023 as set out within sections 5 and 6 of the report be approved.

 

 

3.9       Council Tax Harmonisation

 

            This item was considered at the meeting of Executive on 18 October 2022, where the Executive recommended to County Council on 16 November 2022 that the recommendations of the Council Tax Harmonisation Working Group as detailed in the report.

RECOMMENDATION:

 

 

That the following be agreed in principle subject to the outcome of the public consultation:

 

(i)            the Council Tax levels for the North Yorkshire Council be harmonised over a two year period, commencing in the financial year commencing 1 April 2023;

 

(ii)           the weighted average Council Tax level be maintained for Council Tax harmonisation purposes and that harmonisation be applied on a straight-line basis over the two-year period.

 

 

3.10     Discretionary Council Tax Relief – Section 13A Policy

 

            This item was considered at the meeting of Executive on 25 October 2022, where the Executive recommended to County Council on 16 November 2022 that it approves the implementation of the S13A(1)(C) policy, as set out in Appendix A to the report with effect from 1 April 2023.

RECOMMENDATION:

 

 

That the implementation of the S13A(1)(C) policy, as attached in Appendix A to the report, be implemented.
